1. General
- 1.1 These terms and conditions apply to all offers, orders and agreements made via the webshop www.spicydutchman.nl.
- 1.2 By placing an order, you agree to these terms and conditions.
- 1.3 Spicy Dutchman guarantees that the delivered products match the description and quality stated in the offer.
2. Shipping
- 2.1 Orders are fulfilled while supplies last.
- 2.2 Orders are generally processed and shipped within 1–3 business days. If this is not feasible, you will be notified within 7 days and may cancel your order at no charge.
- 2.3 A shipment is considered offered once the carrier has made the first delivery attempt at the specified address.
- 2.4 Any indicated delivery times are estimates and do not entitle the customer to compensation.
3. Pricing
- 3.1 All prices are listed in euros, including 21% VAT and excluding shipping costs, unless stated otherwise.
- 3.2 Spicy Dutchman reserves the right to adjust prices at any time.
4. Right of Withdrawal (Return Policy)
- 4.1 You have the right to return your order within 14 days of receipt, without providing a reason.
- 4.2 Always notify us by email before returning any item.
- 4.3 Returned products must be unused, undamaged, and – if possible – in their original packaging.
- 4.4 Opened or unsealed food products (such as bottles, jars, or sachets) cannot be returned for hygiene and safety reasons and are excluded from the right of withdrawal.
- 4.5 Customized or personalized items made at your request are also non-returnable.
- 4.6 Return shipping costs are at your own expense unless the return is due to an error or defect on our part.
- 4.7 Refunds will be issued within 14 days after we have received and inspected the return.
5. Data Management & Privacy
- 5.1 Your personal data will only be used to process your order and manage our customer relationship.
- 5.2 Spicy Dutchman does not share personal data with third parties, except for logistics or payment partners necessary for processing your order.
- 5.3 If you subscribe to our newsletter, you can unsubscribe at any time via the link provided in the email.
6. Warranty & Complaints
- 6.1 We take pride in delivering quality products. If a product does not meet your expectations, please contact us.
- 6.2 Complaints must be submitted via email within 7 days of receiving the product.
- 6.3 If a complaint is found to be valid, we will offer a suitable solution, such as replacement or a refund.
- 6.4 Damage resulting from improper use, incorrect storage, or personal modifications is not covered by warranty.
7. Liability
- 7.1 Spicy Dutchman is not liable for indirect or consequential damages, such as loss of profit or product misuse.
- 7.2 Our total liability is in all cases limited to the purchase price of the product in question.
8. Force Majeure
- 8.1 In the event of force majeure (including strikes, natural disasters, pandemics, or transport disruptions), Spicy Dutchman is not obliged to fulfill the agreement or pay compensation.
9. Retention of Ownership
- 9.1 All products remain the property of Spicy Dutchman until full payment has been received.
10. Payment
- 10.1 Payment is made through the available methods provided in the webshop.
- 10.2 Alternative payment arrangements for business customers are only valid if agreed upon in writing.
